These terms apply to the use of the website openqcm.com and to the information it publishes about openQCM devices. openQCM is a brand of Novaetech S.r.l., Piazza Bartolo Longo 28, 80045 Pompei (NA), Italy, VAT IT05132311217, REA NA-735559 (“Novaetech”, “we”, “us”).
1. Purchases
openQCM devices, sensors and accessories are sold through the online store store.openqcm.com. Every order is governed by the store’s General Conditions, Warranty, Shipping and Delivery and Regulatory & Compliance Information pages, in the version in force when the order is placed. If these terms and the store’s conditions differ on a sale, the store’s conditions prevail.
2. Intended use of openQCM devices
openQCM devices are open-source scientific instruments supplied as evaluation and development kits for research and development. They are intended for qualified researchers, engineers and research institutions, to be operated by trained personnel in a controlled laboratory environment. They are not finished products for general consumer use and are not available for consumer purchase.
- They are not CE-marked and are not tested or certified for regulatory compliance; the applicable regulatory notice is published on the store’s Regulatory & Compliance Information page.
- They are not medical devices and must not be used for clinical diagnosis or to take decisions about patients.
- They are not designed or qualified for safety-critical applications (for example life support), for military or automotive use, or for production and commercial deployment.
- Modules intended for space research, such as SpaceBug, are research hardware: qualification for a specific mission or launch is the user’s responsibility.
Before using a device, read its user guide and in particular its safety warnings on temperatures, voltages and materials. The electronics are exposed in some configurations: take the appropriate precautions against electrostatic discharge.
Radio-frequency emissions. The devices generate and use radio-frequency energy and have not been tested for compliance with the limits of Part 15 of the FCC rules or with equivalent standards. Used outside a laboratory, they may interfere with radio communications; in that case the user must take, at their own expense, whatever measures are needed to correct the interference.
3. Responsibility of the user
The user is responsible for the safe handling of the devices, for their use within the intended purpose and for compliance with all legal, regulatory and safety requirements of their own application. Customers who integrate openQCM devices or components into their own products or set-ups are responsible for those products and should provide adequate design and operating safeguards. Technical advice we give on applications is offered in good faith and does not transfer to us the responsibility for the customer’s design or results.
4. Open source, content and trademarks
- Designs and software. openQCM is open hardware and open software. The software is published on github.com/openQCM under the licence stated in each repository (for example GPL-3.0 for the openQCM Q-1 software). Design files, bill of materials and assembly documentation are available on request at info@openqcm.com.
- Website content. Unless stated otherwise, the texts and images of this website are published under the Creative Commons Attribution-NonCommercial-ShareAlike 4.0 International licence (CC BY-NC-SA 4.0). Reproductions must credit openQCM / Novaetech S.r.l., link to the licence and indicate any changes; for commercial use, ask us. Third-party material (for example figures from scientific papers) remains subject to its own licence.
- Trademarks. “openQCM” and “Novaetech” and their logos are trademarks of Novaetech S.r.l. The open licences above do not grant any right to use them in a way that suggests that a product or service comes from or is endorsed by us.
- Except for the licences stated above, no licence under any patent, copyright or other intellectual property right of Novaetech is granted by publishing information on this website.
5. Information on this website
We publish technical information, specifications, figures and examples carefully, but they are provided for information. We may correct, change, improve or discontinue products, specifications and services at any time and without notice: before ordering, check that the information you rely on is current, or ask us. Interactive figures and calculators are illustrations and do not replace the user guide or your own measurements. Information about third-party products does not constitute an endorsement or a warranty, and their use may require a licence from the third party. Links to external websites are provided for convenience; we are not responsible for their content.
6. Resale
Reselling openQCM devices or services with statements that differ from, or go beyond, the parameters stated by Novaetech for that product voids the warranty for that product. Novaetech is not responsible for such statements.
7. Limitation of liability
To the extent permitted by law, Novaetech is not liable for indirect, incidental, special or consequential damages arising from the use of this website, of the information it publishes or of openQCM devices outside their intended use. Nothing in these terms limits liability for wilful misconduct or gross negligence (Article 1229 of the Italian Civil Code), or any other liability that cannot be limited by law, nor the rights that mandatory law gives to the user.
8. Applicable law and jurisdiction
These terms are governed by Italian law. The Court of Naples (Tribunale di Napoli) has exclusive jurisdiction over any dispute arising from them, without prejudice to any mandatory rule that gives a consumer the right to bring or defend proceedings in the courts of their place of residence.
